    143     Software, with GNUnet e.V.'s approval. A Contribution includes its

    150 This contract defines the conditions under which the Contributor
    151 assigns, free of charge, the copyrights over its Contributions as they
    152 are in progress, to GNUnet e.V..  Any participation by the Contributor
    153 or employees of the Contributor will be made under the conditions of
    154 this contract.

    156 Should the Contributor wish to terminate further participation under
    157 the terms of this contract, it will inform GNUnet e.V. of this in
    158 advance and by registered mail to:

    173 \section{EFFECT AND DURATION}

    175 The contract takes effect on the latest date of signing.

    177 The contract shall be enforced for a duration of five years, renewable
    178 by written agreement, as far as the Contributor’s participation in the
    179 development of the Software is concerned.

    181 However, the Contributor’s copyright on the Contributions is assigned
    182 to GNUnet e.V. for as long as said copyrights last.

    184 \section{COPYRIGHTS ASSIGNED TO GNUnet e.V.}

    187   \item is stipulated that copyrights over the Contributions, as
    188     assigned by the Contributor to GNUnet e.V., are the following:

    190     \item The right to reproduce, permanently or temporarily, all or
    191       part of the Contributions, in any format, on any medium and by
    192       any technical means, present or future, necessary for their use.
    193     \item The right to represent all or part of the Contributions, in
    194       any place, public or not, through any form of communication,
    195       present or future, by the means referred to above.
    196     \item The right to adapt for purposes of freely carrying out, on
    197       any medium and by any technical means, any adaptation and/or
    198       modification of all or part of the Contributions, including with
    199       a view to developing derivative software and integrating the
    200       Contributions into a future version of the Software. It is
    201       stipulated that the right of adaptation includes the corrective
    202       and developmental maintenance of the software into which a
    203       Contribution might be integrated.  Therefore, the Contributor
    204       promises to deliver to GNUnet e.V. the source code of the
    205       Contributions transferred, as well as any documentation
    206       pertaining thereto.
    207     \item The right to distribute the Contributions referred to above,
    208       internally or publicly, remunerated or free of charge, directly
    209       or through a provider and/or licensee and/or assignee.
    210     \item The right of using, for operating and making use of, whether
    211       personally or on behalf of a third party, remunerated or free of
    212       charge, the Contributions herein assigned, for the purposes of
    213       carrying out any form of processing, to whatever end.
    214     \item It is agreed that all of the rights considered above are
    215       assigned for the duration of copyright, for the whole world.

    217   It is specified that any author-employee of the Contributor remains
    218   the holder of his or her moral right over said Contributions.
    219   \item In the event that the Contributor wishes to cease submitting
    220     further Contributions, it promises to inform GNUnet e.V. of this
    221     in advance by registered mail with return receipt. It further
    222     promises to ensure that all participation by its employees in the
    223     development of the Software ceases.
    224   \item The Contributor and its employees nevertheless remain free to
    225     use the Software under the conditions provided for by the GNU AGPL
    226     v3 license or any other license which may subsequently become
    227     attached to it.
    228   \item The assignment is non-exclusive. In particular, the
    229     Contributor remains free to make the same Contributions to other
    230     projects and under other licenses.  However, this exception only
    231     applies to the Contribution, and in particular does not relieve
    232     the Contributor from the obligations of the GNU AGPLv3+ or other
    233     licenses of the Software, in cases where these licenses may
    234     otherwise apply to the Contribution.
    235   \item GNUnet e.V. remains free to terminate the submission of
    236     Contributions by the Contributor at any time.

    239 \section{GUARANTEES}

    242  \item The Contributor guarantees that it possesses copyrights over
    243    the Contributions (non-exclusively) transferred and that it holds
    244    all of the rights necessary to assign said Contributions to GNUnet
    245    e.V.. The Contributor guarantees, in particular, that the
    246    Contributions assigned to GNUnet e.V.  do not infringe third
    247    parties' intellectual property rights, including those protected by
    248    patent law.  Should the Contributor become aware, after the
    249    assignment of a Contribution to GNUnet e.V., of details calling
    250    into question this article and the validity of the assignment
    251    covered by this contract, the Contributor promises to inform GNUnet
    252    e.V. of this promptly, in order that the latter may withdraw the
    253    Contribution or Contributions at issue from the Software, as
    254    necessary.
    255  \item The Contributor acknowledges that it holds no patent which
    256    could be enforced against any use by GNUnet e.V. of the copyright over
    257    the Contributions which are assigned to it. In the opposite case,
    258    the Contributor promises to raise no objection to GNUnet e.V., or any of
    259    its licensees, sub- licensees or assignees, on the grounds of the
    260    use of its patent in the Contributions assigned.
    261  \item The Contributor is bound by no obligation to maintain its
    262    Contributions, except as voluntarily undertaken on its
    263    part. Moreover, the Contributor declares that it is assigning its
    264    Contributions ``as they are'', without guarantee as to their
    265    commercial value, and without guaranteeing GNUnet e.V. that the
    266    Contributions are free of errors or correspond to its needs.
    267  \item GNUnet e.V. guarantees that it will continue to distribute
    268    all future versions of the Software under a free software license,
    269    as defined by the Free Software Foundation (\url{http://www.fsf.org/}).

    275  \item This contract is subject to Swiss law.
    276  \item Any dispute concerning the interpretation, validity or
    277    execution of this contract will be submitted, failing an
    278    out-of-court resolution, to the competent German court.
    279  \item If one or several stipulations of this contract are held to be
    280    invalid or declared such in application of a law or regulation, or
    281    by reason of a final ruling by a competent court, the others will
    282    retain all of their force and scope.
